1. Overview

These Terms and Conditions ("Terms") govern your use of the Archify™ website ("Site") operated by Archify™ ("we", "us", or "our"). By accessing or placing an order through this Site, you agree to be bound by these Terms. If you do not agree, please do not use this Site.

2. Products and Descriptions

We make every effort to display and describe our products as accurately as possible. However, we do not guarantee that product descriptions, images, colours, or other content are completely accurate, reliable, or error-free. Minor variations may occur. If a product you receive differs materially from its description, you may return it in accordance with our Returns Policy.

3. Pricing and Payment

All prices listed on the Site are in South African Rand (ZAR) and include VAT where applicable. We reserve the right to change prices at any time without prior notice. Payment must be completed at the time of purchase. We accept payments through the methods displayed at checkout.

In the rare event of a pricing error, we reserve the right to cancel the order and issue a full refund.

4. Orders and Fulfilment

Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including product availability, suspected fraud, or errors in pricing or product information. If your order is cancelled, you will be refunded in full.

Orders are processed within 1–3 business days and shipped by our fulfilment partners. Estimated delivery times are provided at checkout and in our Shipping Policy, but are not guaranteed.

5. Shipping and Delivery

We currently ship to addresses within South Africa only. Shipping is free on all orders. Please refer to our Shipping & Delivery Policy for full details on delivery timeframes and procedures. Delivery times are estimates and may be affected by factors outside our control.

6. Returns, Refunds, and Cancellations

We offer a 30-day return policy from the date of delivery, in line with the Consumer Protection Act 68 of 2008. To be eligible for a return, items must be unused, in their original packaging, and in the same condition you received them.

To initiate a return, please contact us at tryarchify@outlook.com with your order number and reason for the return. Refunds will be processed to the original payment method within 5–10 business days of receiving the returned item.

We reserve the right to refuse returns that do not meet the above conditions.

Cancellations: You may cancel your order within 12 hours of placing it by contacting us at tryarchify@outlook.com. After this window, the order may already have been dispatched and will need to follow the returns process.

7. Consumer Protection

These Terms do not limit or exclude any rights you may have under the Consumer Protection Act 68 of 2008 or any other applicable South African legislation. Where any provision of these Terms conflicts with your statutory rights, your statutory rights shall prevail.

8. Intellectual Property

All content on this Site — including text, images, logos, graphics, and design — is the property of Archify™ or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without our written permission.

9. Limitation of Liability

To the maximum extent permitted by South African law, Archify™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products, including but not limited to loss of profits, data, or goodwill.

Our total liability to you for any claim arising from a transaction shall not exceed the amount you paid for that specific order.

10. Disclaimer of Warranties

Products are provided "as is" and "as available." We make no representations or warranties of any kind, express or implied, regarding the merchantability, fitness for a particular purpose, or non-infringement of any product sold on this Site. We do not guarantee specific results from the use of our products.

11. Indemnification

You agree to indemnify and hold harmless Archify™, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Site, violation of these Terms, or infringement of any rights of a third party.

12. Privacy

Your personal information is handled in accordance with the Protection of Personal Information Act (POPIA) and our Privacy Policy. By using this Site, you consent to the collection and use of your information as described therein.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Gauteng Province, South Africa.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Site following any changes constitutes acceptance of the updated Terms.
